Linkup Paint Supplies Limited General Terms and Conditions relating to Giveaways and Competitions.

1. General
1.1 The promoter is Linkup Paint Supplies Limited (Linkup, we, us).

1.2 These Terms and Conditions apply to all giveaways and competitions Linkup may promote or offer from time to time (Promotions).
1.3 Each Promotion will provide certain terms specific to that Promotion in its relevant flyer or other promotional materials (Specific Terms). To the extent of any inconsistency or conflict between those Specific Terms and these Terms and Conditions, the Specific Terms will prevail. In any circumstance, Linkup offers any Promotion at its sole discretion and without requiring specific consideration to be provided by participants or winners. Accordingly, Linkup's decision on all matters related to the Promotion, including eligibility, is final and is at Linkup's sole discretion.
1.4 The relevant prize, reward, or benefits associated with any Promotion will be specified in the Specific Terms (Reward). A Promotion may have one or more Rewards.
1.5 Each Promotion may include specific eligibility criteria in the Specific Terms. Unless stated otherwise in those Specific Terms, to be eligible to enter any Promotion, you must:
(a) comply with these Terms and Conditions;
(b) provide your full and correct name and contact details;
(c) be 18 years of age or older;
(d) be a New Zealand citizen or resident;
(e) are not employees or agents of the Promoter or any of its related corporations or any agencies associated with the Promotion;
(f) are not a spouse, defacto partner, parent, child or close family member of an employee or agent;
(g) are not otherwise professionally connected with the Promotion.
1.6 Linkup reserves the right to exclude any person from participating in a Promotion for any reason.
1.7 By applying to participate in any Promotion, you agree to be bound by these Terms and Conditions and any Specific Terms.
1.8 Where a Reward involves goods or services supplied by third parties whom Linkup does not control, you acknowledge that any such third party goods or services are governed by that third party’s terms and conditions, and Linkup is not responsible for the availability or quality of any third party goods or services after granting a Reward.
1.9 If you are asked to provide personal information to enter or participate in a Promotion, you consent to us using your personal information for our own business purposes without any payment or other compensation (which may include using or publishing your name or image in our promotional materials, advertising or via our online and social media platforms) and the uses contemplated by our privacy policy which can be found at https://www.linkup.co.nz/privacy-policy.
1.10 If entry to this competition is being made on-line (e.g.) via www.linkup.co.nz, by completing an entry, in addition, the participant agrees to be bound by our website general Terms and Conditions of Use. In the event of conflict between these Competition Terms and Conditions and the website Standard Terms and Conditions of Use, the specific Competition Terms and Conditions will prevail.
1.11 Multiple entries are acceptable (unless otherwise stated by Specific Terms) but each must be made as a separate entry, and with a separate proof of purchase (if you must purchase to enter) where applicable. Entrants may not use any automated voting system.
1.12 If a purchase is necessary to win, this will be made clear.
1.13 Linkup accepts no responsibility for lost or incomplete entries.
1.14 Linkup reserves the right to amend, vary, extend, or discontinue any Promotion at any stage, for any reason.
1.15 Linkup reserves the right to refuse any prize to a person who is reasonably considered to have breached any of the competition terms, or gained unfair advantage in participating in the promotion or obtained a winner status using fraudulent means.
1.16 Each Promotion and these Terms and Conditions are governed by and must be construed in accordance with the laws of New Zealand and is governed by the Commerce Commission. You agree and submit to the exclusive jurisdiction of the New Zealand Courts.
2. Receiving your Reward
2.1 Only the person who originally entered the Promotion can receive a Reward (a Winner).
2.2 A Winner will be determined in the manner set out in the Specific Terms – if not specified, then as determined by Linkup at its discretion.
2.3 Each Winner will be notified at the phone or email provided to Linkup on entry or sign-up. If a Winner cannot be contacted within a reasonable time, Linkup reserves the right to reallocate the Reward to another participant.
2.4 Rewards are not redeemable for cash or transferable. Unless otherwise stated, no other family members, friends, office associates or other persons may participate on the Winner’s behalf. In the event that a Reward specified in the Promotion becomes unavailable for any reason, Linkup may elect to substitute a prize of like or equal value.
2.5 All prizes must be claimed within 60 days of winning. We will do our best to notify the winners of time remaining – it is the sole responsibility of the winner to claim their prize. All unclaimed prizes will be forfeited. We may dispose of any unclaimed prize at the end of 60 days.
2.6 In the event a winner chooses not to accept a prize, they forfeit any claims to the prize, which can then be awarded to a runner-up at our discretion.
2.7 By participating, and accepting a prize, all winners grant Linkup exclusive permission to use their names, characters, photographs, voices and likeness in connection with promotion of this and other related contests and waive any claims to royalty, right or remuneration for such use.
2.8 Each Winner takes Rewards entirely at their own risk and indemnifies Linkup in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with use or enjoyment of the Reward.
